In the name of God Amen.
I, Archibald N. Clemons, of the town of Dresden, county of Washington, state of New York, being of sound mind and memory, and considering the uncertainty of this life, do make, publish, ordain and declare this to be my last will and testament:
First: I will and direct that my executors hereinafter named pay, satisfy and discharge all my just debts and liabilities from my estate, also my funeral expenses and the cost of erecting a suitable headstone over my grave, also the costs, expenses and disbursements incurred in proving this my last will and testament and of carrying the same into effect.
Second: I will and direct my executors hereinafter named, to pay from my estate to my son Abraham A. Clemons, the sum of five hundred dollars ($500.) within one year after my decease, which said sum I specifically devise and bequeath to him and make the said legacy a charge on my real estate.
Third: I also will and direct my executors hereinafter named, to pay from my estate the sum of three hundred dollars ($300.) within one year after my decease to my wife's sister, to wit, Julia Ann LaFleur, which said sum I specifically devise and bequeath to her and make the said legacy a charge on my real estate.
Fourth: Subject to the foregoing and subsequent provisions of this my last will and testament, I hereby give, devise and bequeath to my well beloved wife, Mary Jane Clemons, the use and occupation, rents, issues and profits of all the property, real and personal, of which I may die seized or of which I may die the owner, during her life, giving her the control and management thereof during her life, subject only to the rights of the remainder man[?] hereinafter named as to the preventing of waste and permanent injury to the realty, this is to be accepted by my said wife in lieu of her dower in my estate or of her share in the distribution of any part thereof. On the decease of my said wife, should there be remaining any of the said rents, issues and profits unexpended by her, I will and direct that they lapse into the said estate and be distributed to my son, Robert Nelson Clemons, with the remainder of my said estate.
Fifth: Subject to the life estate of my wife here and above created and subject also to the foregoing and remaining provisions of this my last will and testament, I give, devise and bequeath my estate, real and personal to my son, Robert Nelson Clemons, to be his absolutely and entirely.
Sixth: I direct my surviving executor to pay from my estate the funeral expenses of my wife on her decease and to erect a suitable headstone over her grave.
Seventh: Should my son Abraham A. Clemons, be deceased at my death, or when by the terms of this will and testament he would be entitled to receive the five hundred dollar legacy hereinabove devised and bequeathed to him, and have left no child or children, then I will and direct that the said legacy lapse into my estate. But, if he have deceased and left a child or children surviving then I will and direct that the said legacy be given to said child or children share and share alike if there be more than one child. Also, should my wife's sister, Julia Ann LaFleur, herein aforesaid, have deceased at my death or at the time when by the terms of this will she would be entitled to receive the three hundred dollar legacy herein devised or bequeathed to her and have left no child or children surviving her, then I will and direct that the said three hundred dollars legacy so devised and bequeathed to her as aforesaid lapsed into my estate. But, if she have deceased and left a child or children surviving her, then I will and direct that the said legacy be paid to the said child or children, share and share alike if there be more than one.
Eighth: Likewise, I hereby make, constititute and appoint my son, Robert Nelson Clemons, aforesaid, and my nephew, George L. Clemons, both of Dresden, aforesaid, to be the executors of this my last will and testament, hereby revoking all former wills by me made.
This will is identical in its provisions with my former will made March 9th 1883, except as to the selection of executors, and my reason for re-exesuting the will is owing to the fact of the death of one of the executors named in such first will and to the fact that my son above named as executor has reached mature years.
In witness whereof, I have hereunto affixed my hand, and seal, at Dresden, N.Y., this fourth day of January, A.D. one thousand eight hundred and ninety seven.
